Technical Area: Paper Trials

Welcome to ‘The Technical Area’, a new initiative from the CHO, which invites members to ask technical questions to our legal working group.
As a guarantee, every question received will be reviewed by the group with a personal response sent to the member and a note sent to the membership base to summarise any industry insights which can be gained.

Our first question centres around what appears to be an increased directive in the use of ‘paper trials’ and whether or not these may be beneficial in credit hire claims. This seems to be a fairly new directive, in terms of potential volume, and it is not yet clear whether these may be seen to be advantageous in judgement. However, our legal working group has prepared the attached document of important points to consider when preparing a case for a paper trial.
