Mitigation Statement of Truth

Some of you may already have updated the mitigation statement of truth that many credit hire companies (CHCs) rely on irrespective of whether they are in the GTA or not. This has been raised as an agenda item for the GTA committee but in the meantime, you may want to amend the wording on the template you use.
The Civil Procedure Rules changed on 6 April this year. The statement of truth, currently positioned directly above the signature, which states: ‘I have read and understood the above and I believe that the answers I have given are true,’
needs to be changed to:
‘I believe that the facts stated in this mitigation statement are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.’
